1. Agreement to Terms

Welcome to Up-Lifted Newcomers Inc. ("Up-Lifted," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website and our settlement support services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Up-Lifted Newcomers Inc., a federal corporation incorporated under the Canada Business Corporations Act (Corporation No. 17418035), with its registered office at 900 Bloor St W, Toronto, ON M6H 1L1, Canada.

2. Description of Services

Up-Lifted provides integrated settlement services for newcomers to Canada, including but not limited to:

  • Housing support services (rental guidance, document preparation, landlord connections)
  • Employment services (resume building, interview coaching, job-search support and employment resources)
  • Education services (credential recognition guidance, bridging program information)
  • Information Hub services (AI-powered chatbot, multilingual information access)
  • Mental well-being resources (referrals to counseling, support groups)
  • Career development services (long-term planning, mentorship connections)
  • Community and mentorship programs

3. Eligibility

By using our Services, you represent and warrant that:

  • You have the legal capacity to enter into these Terms
  • You are not prohibited from using the Services under applicable laws
  • The information you provide to us is accurate, complete, and current

4. User Accounts

To access certain features of our Services, you may need to create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account information remains accurate and up-to-date

We reserve the right to suspend or terminate your account if we suspect any unauthorized or fraudulent activity.

5. Payments and Subscriptions

Premium services are billed on a monthly or yearly subscription basis in Canadian dollars (CAD), plus applicable taxes shown at checkout. By purchasing a subscription you expressly agree that:

  • Your subscription renews automatically at the end of each billing period (month or year, as selected) at the then-current price, until you cancel.
  • The price displayed on the booking page is the full price of the service before applicable government taxes; no other mandatory fees are added.
  • Payments are processed securely by Stripe; we never see or store your full card number.
  • If we change a subscription price, we will notify you by email at least 30 days before the change applies to your renewal.

5A. Cancellation and Refunds

You may cancel your subscription at any time, with no cancellation fee, in either of these ways:

  • From your account dashboard at up-liftednc.com (Dashboard → My Bookings), or
  • By emailing hello@up-lifted.ca from the address on your account.

Cancellation takes effect at the end of your current paid billing period — you keep access until then, and no further charges are made. Because access is delivered immediately, we do not provide partial or pro-rated refunds for unused time in a billing period, except where required by law (for example, your statutory rights under the Ontario Consumer Protection Act, 2002).

Nothing in these Terms limits any right or remedy you have under the Ontario Consumer Protection Act, 2002, including rights relating to internet agreements and disclosure.

6. Canadian Tax Compliance

Applicable taxes are added at checkout based on your province: Ontario: 13% HST · Atlantic Provinces (NS, NB, NL, PEI): 15% HST · Quebec: 5% GST + 9.975% QST · BC, Manitoba, Saskatchewan: 5% GST + PST · Alberta and territories: 5% GST.

7. Intellectual Property

All content on our Website, including text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of Up-Lifted Newcomers Inc. or our content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any of our content without our prior written consent.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Up-Lifted Newcomers Inc. and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

  • Your use of or inability to use our Services
  • Decisions made based on information provided through our Services
  • Unauthorized access to or alteration of your transmissions or data
  • Any other matter relating to our Services

9. Indemnification

You agree to indemnify, defend, and hold harmless Up-Lifted Newcomers Inc., its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Services or violation of these Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

11. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on this page. By continuing to use the Services after revisions become effective, you agree to be bound by the revised Terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
